Quotations and agreement

Quotations are valid for the stated period, or 30 calendar days if none is stated. A contract is formed when the customer approves the quotation in writing or digitally, after receiving these terms. Sending a contact enquiry is not an order.

Prices

The quotation states the price, VAT treatment and additional costs. Consumers receive the total price including applicable taxes and mandatory charges before agreeing. Work outside the agreed scope is discussed and quoted before it starts.

Payment

Unless the quotation says otherwise, website projects are paid 40% on approval, 40% after design or main development approval and 20% on delivery. Work starts after the agreed advance is received. Invoice due dates apply. Overdue payments may lead to lawful suspension after notice. Consumers first receive a free reminder and at least 14 calendar days to pay, starting the day after an electronic reminder or the third working day after postal dispatch. Any agreed interest or compensation remains subject to statutory limits.

Planning

Delivery estimates are indicative unless expressly agreed otherwise in writing. Late customer content, decisions or feedback may require a revised schedule.

Customer materials

Customers must provide accurate, lawful materials and have the necessary rights to use them. Responsibility for infringement arising from supplied materials is determined under applicable law; this does not exclude responsibility for KNG Digital’s own conduct.

Design revisions

The quotation states the included revision rounds; otherwise two rounds are included. Each is one consolidated set of comments and limited changes. Major changes to approved structure, design or functionality may require a separate quote.

Additional work

Extra pages, features, integrations, major redesigns and work on third-party systems outside the quotation are additional work. They begin only after discussion and agreement with the customer.

Delivery and review

Delivery takes place when the agreed features are available and the customer has had an opportunity to review them. Please report visible issues within seven days so they can be investigated promptly; this does not remove statutory rights. Minor defects do not automatically justify withholding all outstanding payment, subject to mandatory consumer rights.

Intellectual property

Until full payment, KNG Digital retains rights in its own work where those rights belong to it. After payment, the customer receives the agreed rights to the specific end product. Reusable components, methods and templates remain with KNG Digital unless agreed otherwise. Third-party software, fonts, images and other assets retain their own licence conditions.

Portfolio references

Delivered work may be shown as a portfolio reference unless agreed otherwise in advance. Confidential customer information is not disclosed.

Hosting

Hosting follows the quotation and is normally invoiced annually in advance. Non-payment may lead to suspension or termination after notice and subject to applicable law. Continuous or fault-free availability cannot be guaranteed in the event of provider or infrastructure incidents, maintenance or events outside reasonable control.

Maintenance

Maintenance requires a separate agreement. It may include updates, backups, checks, limited support and small content changes of up to one working hour where agreed. New pages, redesigns and new features are not automatically included. Unused maintenance time does not roll over to the next month.

Domain names

Domains remain registered in the customer’s name and are the customer’s responsibility unless agreed otherwise in writing. Technical management may include DNS and hosting configuration. Renewal and payment responsibilities are set out in the agreement.

External services

Third-party services and software may be subject to their own terms, fees and licences. Material dependencies are discussed for the project. Each party remains responsible for its own contractual obligations.

Search optimisation

SEO work follows the agreed scope. No particular position in search results is guaranteed: rankings also depend on competition and search-engine changes.

Security and backups

Reasonable technical measures are used to maintain security. No website or hosting environment can be guaranteed against all attacks, faults or data loss. Backup arrangements must be specified in the applicable service agreement.

Liability

Each party is responsible for damages payable under applicable law. These terms do not exclude liability for intentional misconduct, gross negligence, harm to life or physical integrity, or failure to perform essential contractual obligations. Mandatory consumer rights remain unaffected.

Project cancellation

Cancellation is settled according to demonstrably completed work and reasonable non-recoverable costs, without double recovery. Any excess advance is refunded. Statutory withdrawal follows the consumer rules below. If essential feedback or materials are missing for 30 days, the project may be paused and a new schedule proposed.

Ending hosting or maintenance

Maintenance may be ended with one month’s notice. Hosting is agreed for one year and renews annually unless cancelled in writing at least 30 calendar days before renewal. For consumers, renewal conditions must be supplied beforehand in the legally required form. After the first automatic renewal, consumers can cancel without a cancellation fee on one month’s notice. Transfer arrangements should be agreed in a reasonable period after termination, subject to technical feasibility, payment obligations and mandatory legal rights.

Changes to these terms

Updated terms apply to future work. Existing contracts retain the terms accepted at formation unless both parties agree otherwise or mandatory law requires a change.

Law and complaints

Belgian law applies, without depriving consumers of mandatory protections applicable to them. Please send complaints to info@kngdigital.be so we can seek an agreed solution. Unresolved disputes go to the competent court under applicable law.

Consumer withdrawal

Distance contracts

For distance service contracts, consumers generally have 14 calendar days starting the day after the contract is made to withdraw without giving a reason. Send a clear statement to info@kngdigital.be or our postal address before the deadline. Work during that period starts only on an express request. A proportionate charge for services already supplied may apply after such a request, subject to the statutory information requirements. The right is lost after full performance only with prior express consent and acknowledgement of that loss. A custom website is not automatically exempt. Refunds due after valid withdrawal are made within 14 days of notice using the original payment method unless otherwise agreed without cost. Any specific rules for digital content are explained separately before agreement.
